Senate Republicans upheld a filibuster Thursday of an Obama administration judicial nominee to the ninth circuit court of appeals.
Sen. John Cornyn was one of 42 Republicans and one Democrat who opposed the confirmation of Goodwin Liu, a University of California, Berkeley School of Law, professor. Sen. Kay Bailey Hutchison did not vote. Aides said she was in Dallas dealing with a family matter.
"Given his lack of temperament, his poor judgment, and his activist view of the role of judges and the law, I'm left with no choice but to fight Professor Liu's confirmation with every tool at my disposal," Cornyn said on the Senate floor before the vote.
Sens. Cornyn and Hutchison made the argument six years ago that under the Constitution, judicial nominees must get an up-or-down vote. On that basis, they denounced the Democrats' use of filibusters to block judicial nominees -- the same tactic Republicans employed with Liu. Read their comments in an earlier post.
